摘要
我國農村土地進行流轉始于上世紀80年代后期，最先在我國發達的東部沿海地區出現。目前，土地流轉已經變得十分普遍。中共十七屆三中全會制定并頒布《中共中央關于推進農村改革發展若干重大問題的決定》后，中國的農用地流轉，更是如火如荼開展起來。土地流轉觸及農民醫療、就業、養老等多方面的權益保障。許多失去土地的農民，喪失了生活來源，生存權也受到威脅。這些問題影響到農村的穩定，對社會保障制度提出了挑戰。
當下，在我國廣大的農村，存在形式多樣的土地流轉。農用地流轉依然存在不合規現象，而且遇到諸多制度上的難題。最突出的問題是，對農民合法權益保護力度不充分。農民的權益保護是重要的法律問題，同樣也是嚴肅的政治問題。如果沒有很好地保障農民的合法權益，就會降低農民對土地流轉的積極性，也無法有效進行土地轉流。本文嘗試從強化對土地承包經營權的保障視角，探討對農民財產權利加以保護。論文的研宄希望能實現，當前及我國今后農地流轉的健康發展，維護農民土地權益，加快農村土地制度改革的推進。

ABSTRACT
Rural land circulation in China began in the late 80's of the last century, first appeared in somedeveloped coastal regions. So far, land circulation in rural areas is a very common. Especially afterthe “decision” of the CPC Central Committee on rural reform and development of a number of majorissues in the seventeen session of third session, rural land transfer developed rapidly. Landcirculation affects medical care,employment, pensions and other rights of the famers. As somefarmers loss land,they also loss income, even their existence rights are threatened. These factorsinfluence stability of rural regions and challenge social security system.
At present, in China's rural areas there are a variety of forms and ways of land circulation.
However, some land circulation do not comply with laws and policies, there are many problems. Oneof the most prominent problem is the lack of protection of the legitimate rights and interests offarmers. Farmer rights and interests protection is not only an important legal problem, but also aserious political problem. If legal rights of farmers are not well protected, the enthusiasm of thefarmers on the land transfer will be adversely affected. This paper attempts to start from theperspective of strengthening property rights protection of farmers, discusses property rightsprotection of farmers. The research aims at promotion of healthy development of land circulation,protection of farmers' rights,and improvement of rural land system.
